Obama Administration Creates a New Crime

The Obama administration has (again) delayed the implementation of Obamacare for companies employing anywhere from 50-99 workers. The implementation date for these companies has been delayed until 2016 which is well after the mid-term election. While the Obama administration delaying or changing the law is nothing new or shocking, what is shocking about this new delay is what companies have to do when they apply for the delay.
Obama officials made clear in a press briefing that firms would not be allowed to lay off workers to get into the preferred class of those businesses with 50 to 99 employees. How will the feds know what employers were thinking when hiring and firing? Simple. Firms will be required to certify to the IRS – under penalty of perjury – that ObamaCare was not a motivating factor in their staffing decisions. To avoid ObamaCare costs you must swear that you are not trying to avoid ObamaCare costs.
Judge Napolitano appeared on The Kelly File on February 10 to discuss these new Obamacare “rules” and according to him President Obama “absolutely cannot do that. He cannot create a crime.” He went on to say that if “in order to do X you must swear that you’re not doing Y and if you don’t swear that you’re not doing Y – it’s perjury, he is creating a crime which he absolutely is forbidden from doing”
Incredible? No, not really. Illegal? Unconstitutional? Absolutely, but if Congress, the Court, or the American people aren’t willing to try to stop him – he will continue to take these “liberties” and rule our country like the dictator that he is.
