Filibuster Busted, Separation of Powers Nuked

dedc6a3c1a52427a2cf3dcbcb25d2368“Were the executive power not to have a right of restraining the encroachments of the legislative body, the latter would become despotic; for as it might arrogate to itself what authority it pleased, it would soon destroy all the other powers.” ~ Charles Secondat, Baron de Montesquieu, French Philosopher

“An elective despotism was not the government we fought for; but one in which the powers of government should be so divided and balanced among the several bodies of magistracy as that no one could transcend their legal limits without being effectually checked and restrained by the others.” ~James Madison, Federalist Paper No. 84

Last week I reported on how Obama has openly stated that he planned on “remaking the courts”, and how democrats were allowing for the possibility of stacking the courts with Obama’s judicial nominees.

What happened last Thursday on November 21, when the Senate approved the use of the Nuclear option to stop filibusters and allow for a simple majority of 51 votes, is quite simply, a tyrannical power grab which allows Obama to do whatever he wants once his nominees are approved and appointed.

Led by Senate Majority Leader Harry Reid, the Senate Democrats voted almost completely along party lines, with only a handful of democrats voting with the republican minority against the measure, passed an Amendment to Senate filibuster rules- invoking the long debated Nuclear option which shuts down minority power of blocking any of the Presidential nominations.

Keep in mind, Senator Reid has in the past lambasted republicans for threatening the same action when it was GW Bush’s appointees in 2005, claiming that it was a way “which would change our country forever” and that “As long as I’m leader, the answer is no,” when it came to the idea of invoking the nuclear option.

Senator Hillary Clinton invoked the Founding Fathers, claiming that the “nuclear option ignores precedent for gratification of President.”

Senator Dick Durban called it a “power grab and an assault on the checks and balances.”

Then Sen. Joe Biden claimed, “I think this is the single most significant vote anyone of us will cast in my 32 years in the Senate,” going on to call the nuclear option a “power grab”.

Then Senator Barack Obama said, “Everyone in this chamber knows that if the majority chooses to end the filibuster – if they choose to change the rules and put an end to democratic debate, then the fighting and the bitterness and the gridlock will only get worse.”

This is the ultimate in hypocrisy coming from Obama, as it has now been reported that he lobbied for the filibuster change and the Democrat Senate’s push for approval of his nominees.

It would seem to me, that the American people, no matter which political leanings they have, would be alarmed by last Thursday’s Amendment change. Invoking this rule, right now may seem perfectly fine to liberals and uninformed citizens, because their party is in control- but what they have done is more than just consent to mob rule.  When democrats were in the minority, they saw any measure as a bully tactic meant on shutting out dissenting views.  You know what? They were right then, but they are so wrong now.

It is not just a bully tactic. This administration has been proven over and over again during the past 5 years that it does not have American’s best interest in mind.  From everything from calling Americans “bitter clingers”, to Benghazi- from the IRS targeting Conservative groups for audits to Fast and Furious and even going after the press, for this administration to be given power it was never meant to have is a frightening possibility of granting a scepter of rule which We the People will never have a chance to have true representation.

With Obama’s propensity towards Executive Orders, he has found his way to bypass Congress, now with full democrat Senate support, he will have his remade courts, in his image, and there will be no dissenting opinion allowed.

Do people understand that this means there will be no longer the Separation of Powers between the 3 branches of our Federal Government?  Many people love to toss around the idea of a wall Separation between Church and State, but where there is no Constitutional wall which disallows churches to keep out of politics, there has been a most important Wall of Separation between the 3 distinct branches giving each the Executive, the Legislative and Judicial branches powers but more importantly to act as a system of checks so neither becomes more powerful than the others.

The Democrat led senate, which found the filibuster rule abhorrent less than a decade ago have now used it to blast through that wall and have given full power to the Executive Branch. Power to sign EO’s for treaties which do not recognize America’s sovereign Constitutional Laws, power to grant amnesty to millions of people who have no regard for America’s laws or allegiance to our Constitution, and any gun control grab they deem necessary for citizens’ own protections even though our Constitution protects our 2nd Amendment right.

And why did our Founders include the 2nd Amendment right to keep and bear arms?  They did so because it helps protect us from having all of our other rights- inalienable rights from being stripped away, by a tyrannical government of elites who rule instead of representing We the People.

Because our Founding fathers knew what tyrannical government was, and in the words of James Madison, “The accumulation of all powers, legislative, executive, and judiciary, in the same hands, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly be pronounced the very definition of tyranny.”

You Are Americans. For now you still have a voice. I’d suggest you use it and contact every Senator and demand this be repealed.
